DMCA Policy

Afferte LLC, a Nevada limited liability company, doing business as WovenTribute (“WovenTribute”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to claims of copyright infringement committed using the WovenTribute platform.

Filing a DMCA Takedown Notice

If you believe that content on WovenTribute infringes your copyright, you may submit a takedown notice to our DMCA Agent. Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the infringing material and information sufficient to locate it on our platform (such as the tribute URL)
  4. Your contact information, including name, address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf

Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification with our DMCA Agent. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or Clark County, Nevada, if you are outside the United States) and that you will accept service of process from the person who provided the original takedown notice

We will forward your counter-notification to the original complainant. If we do not receive notice of a court action within 10-14 business days, we may restore the removed content.

Repeat Infringers

We maintain a policy of terminating the accounts of users who are repeat copyright infringers, in appropriate circumstances as determined by us.

Good Faith

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages.
