Terms of Service

Welcome to WovenTribute. These Terms of Service (“Terms”) govern your use of the WovenTribute platform, website, and services (collectively, the “Service”) operated by Afferte LLC, a Nevada limited liability company, doing business as WovenTribute (“WovenTribute,” “we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

WovenTribute is an AI-powered tribute platform that allows users to create, assemble, and share multimedia tributes. Users can upload photos, videos, and text messages, which our AI technology organizes into a curated web experience and optional video export.

The Service offers two creation modes: Solo Mode (single user uploads all content) and Group Mode (an organizer invites contributors to submit content).

2. Accounts

You must create an account to use most features of the Service. You agree to provide accurate, current information and to keep your login credentials secure. You are responsible for all activity under your account.

You must be at least 13 years of age to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Inactivity

Accounts that have not been accessed (no login) for a period of 24 consecutive months may be deactivated. We will send a notification to your registered email address approximately 60 days before deactivation. Logging in at any time resets the inactivity period. Deactivated accounts and their associated tributes and media may be permanently deleted. If you wish to preserve your content, please ensure you log in to your account periodically.

4. Subscription Plans and Billing

4.1 Free Tier

The Free tier allows you to create tributes with limited features at no cost. Free tributes have a 30-day active lifespan, measured by cumulative time the tribute is published (not calendar time from creation). The clock pauses when a tribute is deactivated and resumes when reactivated.

4.2 Subscription Plans

We offer monthly ($14.99/month) and annual ($99/year) subscription plans. Subscriptions renew automatically at the end of each billing cycle unless cancelled. You may cancel at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.

4.3 Single Full Tribute

We offer a one-time purchase option ($24.99) that unlocks paid features for a single tribute for 18 months of published time, measured by cumulative time the tribute is published. The clock pauses when a tribute is deactivated and resumes when reactivated.

4.4 Refunds

Subscription fees are generally non-refundable. If you believe you have been charged in error, contact us within 14 days of the charge. One-time Single Full Tribute purchases are non-refundable once the tribute has been published. We reserve the right to issue refunds at our discretion.

4.5 Price Changes

We may change our pricing at any time. For active subscribers, price changes take effect at the start of the next billing cycle. We will provide at least 30 days’ notice of price increases via email.

5. User Content

5.1 Your Content

You retain all ownership rights in the photos, videos, text, and other content you upload to the Service (“User Content”). By uploading User Content, you grant WovenTribute a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and process your User Content solely for the purpose of providing and improving the Service. This license exists only as long as your content remains on the platform.

5.2 Content Responsibility

You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and share all User Content. You are solely responsible for ensuring your content does not infringe on the intellectual property rights, privacy rights, or other rights of any third party.

By uploading content, you confirm that:

5.3 Prohibited Content

You may not upload content that: is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene; infringes on any patent, trademark, copyright, or other intellectual property right; contains viruses, malware, or other harmful code; exploits minors in any way; or violates any applicable law or regulation.

5.4 Content Removal

We reserve the right to remove any User Content that violates these Terms, without prior notice. We are not obligated to monitor User Content, but we may do so at our discretion.

6. Contributor Content

Contributors are individuals who submit content to a tribute via an invitation link, without creating an account. Contributors agree to these Terms by submitting content. The organizer of a tribute has the ability to approve, reject, reorder, or remove contributor content.

Contributors retain ownership of their submitted content but grant the same license described in Section 5.1 to both WovenTribute and the tribute organizer.

7. AI-Generated Assembly

The Service uses artificial intelligence to organize, arrange, and present User Content. The AI assembly is an automated process that makes creative decisions about layout, ordering, pacing, and visual presentation. While we strive for high-quality results, AI assembly is provided “as-is” and may not always meet your expectations. Organizers can manually adjust and override AI decisions.

8. Intellectual Property

The Service, including its design, code, AI technology, themes, visual assets, and documentation, is owned by WovenTribute and protected by intellectual property laws. These Terms do not grant you any right to use WovenTribute’s name, logo, or branding.

9. Copyright Infringement and DMCA

We respect the intellectual property rights of others. If you believe content on our platform infringes your copyright, please see our DMCA Policy for instructions on submitting a takedown notice.

We will respond to valid DMCA takedown notices and may terminate the accounts of repeat infringers.

10. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or its systems; interfere with or disrupt the Service; upload content that you do not have the right to share; use automated means (bots, scrapers) to access the Service without our permission; resell or redistribute the Service; or impersonate any person or entity.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF AI-GENERATED ASSEMBLY OR ANY CONTENT ON THE PLATFORM.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOVENTRIBUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless WovenTribute and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Clark County, Nevada.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
